Thank you for using ListReports! Your trust is important to us, which is why we’re committed to protecting the privacy and security of your personally identifiable information (“Personal Information”). 

This Privacy Policy describes the types of information ListReports, Inc. (collectively, “ListReports,” “we,” “us,” or “our”) gather and how we collect, use, and disclose that information, including your Personal Information, when you visit or use our ListReports website, including any subdomains, and any other websites (collectively, our “Site”), our mobile, tablet, and other smart device applications, and application program interfaces (collectively, “Applications”), and all associated services (collectively, our “LR Services”). Together, the Site, Application, and LR Services are referred to as the “LR Platform” in this Privacy Policy. This Privacy Policy also explains our information management practices, including how your information is safeguarded and the degree to which you may control the maintenance and sharing of that information. You can access our Platform in many ways, and this Privacy Policy will apply regardless of the means of access. (Any undefined term in this Privacy Policy (such as “LR Account” and “Member”), has the same definition as in our Terms of Service). Your use of the LR Platform constitutes acceptance and agreement with this Privacy Policy and any additional applicable terms.

Please note that our LR Platform is intended for use only in the United States of America (USA), all other use is prohibited. Accordingly, our privacy program is designed to comply with the laws of the USA and the individual U.S. States. 

We provide important information for California residents at the bottom of this page.

1Information We Collect

A. Information you provide to us when using the LR Platform

Real Estate Professionals on the LR Platform: Our registered real estate professional Members (“REPs) with a LR Account share their professional identities, engage with their network, and access and use the LR Platform. To do so, we ask for and collect the following personal information when you use the LR Platform. This information is necessary to provide the LR Services to you; without it, we may not be able to provide you with the requested services.

  • Account Information. When you sign up for a LR Account, we require certain information such as your first name, last name, email address, phone number, business address, profile picture, industry Identification number (collectively, your “Public Profile”); and certain professional information such as brokerage affiliation, associations, licensing history, and associated listings and sales (collectively, along with your Public Profile, your “Professional Information”). In addition, in order to establish a LR Account, you will be required to provide us your username, password, interests, and preferences (“Profile Data”).

  • Listing Information. To use certain features of the LR Platform (such as creating a marketing kit), we may ask you to provide additional information, such as the property address and details of listings, and information about the surrounding neighborhood.

  • Payment Information. To pay for certain LR Services, including a paid subscription, we may require you to provide certain financial information (like your credit card information) in order to facilitate the processing of payments.

  • Communications with ListReports and other Members. When you communicate with ListReports or use the LR Platform to communicate with other Members, we collect information about your communication and any information you choose to provide.

  • Client and REP Contact Information. You may choose to import the contact information of your Consumer clients and/or REP colleagues, or enter that information manually to access certain features of the LR Platform, like inviting your clients or colleagues to use ListReports. 

  • Member Content. While using our ListReports Services, you may upload, transmit, provide or create additional information while using that service (“Member Content”), as further detailed in the Member Content section below. 

  • Other Information. You may otherwise choose to provide us information when you fill in a form, update or add information to your LR Account, respond to surveys, participate in promotions, communicate with our customer support team, or use other features of the LR Platform.

Consumers on the LR Platform: To help find your next home, provide you with market insights on both properties and neighborhoods, and the opportunity to collaborate with Real Estate Professionals, we ask that our Consumer Members provide the personal information described below. This information is necessary to provide you our LR Services.

  • Account Information.  In some cases, you may be asked to create a LR Account. When you do so, we require you to provide certain personal information such as your first name, last name, email address, mobile phone number (your “Contact Information”). In addition, in order to establish a LR Account, you will be required to provide us your username, password, interests, and preferences (“Profile Data”).

  • Listing  Information. To use certain features of the LR Platform (such as searching for a home on Robin), we may ask you to provide additional information, such as the property address and details of listings, information about certain neighborhoods, and/or Member Content, like home photos. You may also provide us your household data, such as owners information, mortgage data, property details, and other real estate and other information (“Household Data”).

  • Communications with ListReports and other Members. When you communicate with ListReports or use the LR Platform to communicate with other Members, we collect information about your communication and any information you choose to provide. 

  • Co-Buyer and REP Information. You may choose to invite your co-buyer or a REP to the LR Platform by entering their contact information. 

  • Member Content. While using the LR Platform, you may upload, transmit, provide or create Member Content, including the type of home you’re looking for, information relating to your current home, and/or notes on your home search. 

  • Other Information. You may otherwise choose to provide us information when you fill in a form, update or add information to your LR Account, respond to surveys, participate in promotions, communicate with our customer support team, or use other features of the LR Platform.

    B. Information we collect when you use our LR Platform

When you use the LR Platform, we automatically collect personal information about the services you use and how you use them. This collection may include:

  • Usage Information. We collect information about your interactions with the LR Platform such as the pages or content you view, your searches, your Pairings, and other actions on the LR Platform.

  • Log Data and Device Information. We automatically collect log data and device information when you access and use the LR Platform, even if you have not created an LR Account or logged in. That information includes, among other things: details about how you’ve used the LR Platform (including if you clicked on links to third-party applications), IP address, access dates and times, hardware and software information, device information, device event information, unique identifiers, operating system version, configuration data, crash data, cookie data, and the pages you’ve viewed or engaged with before or after using the LR Platform.

  • Cookies and Similar Technologies. We use cookies and other similar technologies when you use our LR Platform, use our Application, or engage with our email communications. We may collect certain information by automated means using technologies such as cookies, browser analysis tools, web beacons, server logs, and mobile identifiers. In many cases, the information we collect using cookies and other tools is only used in a non-identifiable without reference to Personal Information. For example, we may use the information we collect to better understand website traffic patterns and to optimize our website experience. In some cases, we associate the information we collect using cookies and other technology with your personal information. Our business partners may also use these tracking technologies on the LR Platform. (You can disable cookies, limit the types of cookies you allow, or set your browser to alert you when cookies are being sent. Please refer to guidance provided by your individual web browser if you'd like help in managing your cookie preferences.) 

  • Do Not Track Signals. While you may disable the usage of cookies through your browser settings, the LR Platform currently does not respond to a “Do Not Track” signal in the HTTP header from your browser or mobile application due to a lack of standardization regarding how that signal should be interpreted.

  • Geo-location Information. When you use certain features of the LR Platform, we may collect information about your precise or approximate location as determined through data such as your IP address or mobile device’s GPS to offer you an improved user experience. Most mobile devices allow you to control or disable the use of location services for applications in the device’s settings menu. 

    C. Information we collect from public sources and third parties

ListReports also collects certain information, including Personal Information, that others provide about you when they use the LR Platform, or obtain information from third-party sources (collectively “Third Party Data”) and combine that with the information we collect through your use of the LR Platform.This information may include:

  • Publicly Available Real Estate Information: ListReports collects information from public sources, such as county and state tax and property records, government agencies, and multiple listing services (MLS), or third-party services with whom we have contracted to collect this information on our behalf. We also collect certain publicly available Professional Information such as brokerage affiliation, associated listings and sales, and licensing history. Most of this information is about properties, not people. But some information we collect, like the identity of a property’s owner or real estate license information, may relate to individuals.  

  • Enterprise Contracts. In some cases, your use of the LR Platform may be part of a company-wide agreement between your company, affiliate, or other entity and ListReports (an “Enterprise Contract”). In such cases, the administrator of your Enterprise Contract may provide your account information, such as your profile information, to us directly on your behalf. 

  • Information from other Members. We may also obtain information about you from another Member and/or Consumer who uses the ListReports Platform. For example, we may receive Personal Information, like your name and contact information, directly from your real estate agent. Likewise, if you are invited to use the LR Platform, the person who invited you may submit Personal Information about you such as your email address or other contact information. 

  • Third Party Platform Login. Third party platforms. If you choose to login to the LR Platform via a third-party platform or social media network, or otherwise connect your account on the third-party platform or network to your account through the Service, we may collect information from that platform or network. For example, this information may include your username, user ID, profile picture, cover photo, and networks to which you belong (e.g., school, workplace). You may also have the opportunity to provide us with additional information via the third-party platform or network, such as a list of your friends or connections and your email address. You can read more about your privacy choices in the “Your Choices and Control” section, below.

More about Member Content. Member Content is information provided by a Member and/or Consumer to ListReports and other Members and/or Consumers through the use of our ListReports Services. Member Content includes the content contained in posts, video conferences, chats, files, and notes shared while using our ListReports Platform.  

Children’s Data. Our LR Platform, including our Site and Application, is not directed to anyone under 18 and we do not knowingly collect any personal information directly from children or anyone under 18. If you believe that we are processing the personal information pertaining to a child inappropriately, we take this very seriously and urge you to contact us at support@listreports.com.

2How We Use the Information We Collect

We use, store, and process Personal Information to provide, understand, improve, and develop the LR Platform such as to: 

  • enable you to access and use the LR Platform,

  • provide the ability to create, establish, and maintain your personal profile and account, 

  • verify your account and/or Professional Information (such as MLS or NMLS number),

  • facilitate social features of the Service, such as by identifying and suggesting connections with other users of the Service and providing chat or messaging functionality,

  • enable you to communicate with other LR Members,

  • enable meetings and video conferences between Members,

  • host and store personal data from meetings and video conferences on behalf and at the direction of the meeting host, 

  • operate, protect, improve, and optimize the LR Platform and experience, such as by performing analytics and conducting research,

  • provide customer service,

  • send you service or support messages, updates, security alerts, and account notifications,

  • if you provide us with your contacts’ information, we may process this information: (i) to facilitate your invitations and (ii) for any other purpose you authorize at the time of collection,

  • to operate, protect, improve, and optimize the LR Platform and experience, and personalize and customize your experience, 

  • enable your use of an Enterprise Contract, 

  • to verify your compliance with our Terms of Service and other agreements and policies,

  • comply with legal obligations, 

  • detect and prevent fraud, spam, abuse, security incidents, and other harmful activity,

  • send you promotional messages, marketing, advertising, and other information that may be of interest to you (including information about ListReports or partner campaigns and services) and social media advertising through social media platforms such as Facebook or Google),

  • administer referral programs, rewards, surveys, sweepstakes, contests, or other promotional activities or events sponsored or managed by ListReports or its third party partners, and

  • invite you to events and relevant opportunities.

We process this personal information for these purposes given our legitimate interest in improving the LR Platform and our Members’ experience with it, and where it is necessary for the performance of our commitment to provide the LR Services to you.

We may also use information associated with your account, such as a unique identifier, for attribution or record-keeping purposes as part of our relationship with third-party partners. For example, if you click on an advertisement shown on our Site that takes you to a third-party partner and purchase a product from that third-party, we may pass a unique identifier to that third party partner in order to track that activity.

3.  How We Share and Disclose the Information We Collect 

ListReports is committed to sharing information only when needed for a legitimate business or legal purpose, and then only with recipients who will protect it.

For Real Estate Professionals

  • Your Public Profile: Your Profile information is viewable to all other Members on our LR Platform and, when you request certain LR Services like  a Marketing Kit, this Profile information will be included on those LR Services and shared with your customers and other REPs as requested. 

  • Your Professional Information: We make your publicly available Professional Information (such as brokerage affiliation, license number, market, market activity and similar Third Party Data related to your business) available to other Members on our LR Platform. 

  • Certain Activities on our Platform: When you are Paired with another Member, we may share some of your activities on the LR Platform with your Paired Members. For example, when an Agent accesses and uses some of our LR Services that Agent’s Paired Lender and/or Title Rep may be notified of that activity.   

  • Enterprise Accounts: If you are part of an Enterprise Contract, the administrator of your Enterprise will have access to your LR Account and Public Profile, and can review and manage your use of the LR Services. 

For Consumers

  • Your Contact Information: When you create a LR Account, your Contact Information (including your name, email address, and mobile phone number) will be shared with the Agent with whom you are collaborating on the LR Platform, as well as the Agent’s Paired Lender. In addition, certain LR Services may give you the opportunity to connect with Real Estate Professionals. If you choose to do so, we will share your Contact Information with those Real Estate Professionals on your behalf. 

  • Certain Activities on our Platform: When you are collaborating with Real Estate Professionals on our LR Platform, we may share some of your activities on the LR Platform with your Paired Members. For example, when you create home preferences or like or dislike certain homes, your Agent and that Agent’s Paired Lender may be notified of that activity.   

  • Certain Household Data: As described above, we collect certain publicly available information about home valuation and other home ownership information from third party providers, you may also choose to update or provide similar Household Data yourself, including mortgage data. You may choose to share some of this information with your Paired Members. 

For All Members

  • Other information you ask us to share: We share information when you ask us to share it. For example, if you choose to contact a real estate professional Member on our LR Platform, we will send them your name and contact information. Similarly, when you ask us to share a piece of Marketing Collateral (like a Single Property Flyer or a Shareable) on social media sites like Facebook, you provide us consent to share your information, including personal account information, to that third party in order to provide the service you requested. (Keep in mind the social media platforms with which you ask us to share your personal information are not controlled or supervised by ListReports; any questions regarding how they process your personal information should be directed to that provider). Likewise, when you decide to message or post a note to a Member or Consumer on the LR Platform, we will share your message or note as directed. In addition, all such shared information is subject to our Rules of Conduct on the LR Terms of Service. 

  • Service providers and business partners: When ListReports contracts with a service provider to help operate certain LR Services, we may give them access to certain information to provide that service and/or to make that service more seamless for you. These providers have limited access to your personal information to perform specific tasks on our behalf, and are contractually bound to protect your personal information and only use personal information in accordance with our instructions. Likewise, when ListReports partners with other businesses to offer products and services to you, we may share information with those partners only as needed to provide those products and services.

  • Compliance, Preventing Harm, and Protecting Our Rights: We do not share personal information that directly identifies you (such as your name, email, or home address) with third parties for their own use without your consent, unless it is either required by law or we determine that disclosure is reasonably necessary to enforce our rights, comply with our legal obligations, or to protect our consumers or third parties.

  • Aggregate Data: We may also share anonymous or aggregated information (information about our users that we combine together so that it no longer identifies or references an individual user) and other anonymized information for regulatory compliance, industry and market analysis, demographic profiling, marketing and advertising, and other business purposes.

  • Third-Party Integration and Advertising: When third-party technologies or social tools are integrated into our LR Platform, those third parties may collect information when you use our LR Platform. That information will be associated with your browser or device in order to serve more relevant ads on our Site or others. In addition, we may pass aggregate information on the usage of our Site to third parties, but this will not include information that can be used to identify you. We do not control or supervise how these third parties process your Personal Information and disclaim responsibility or liability for their activities. Nonetheless, we seek to protect the integrity of our site and welcome any feedback about these sites. 

  • Merger or Acquisition: In the event of a reorganization, divestiture, merger, sale, or bankruptcy, we may transfer all information we collect to the relevant third party and will obtain your consent to do so if required by law.

4. Your Choices and Controls 

Consistent with applicable law, you may exercise any of the rights described in this section. In some cases, to exercise such rights, you must contact us directly. To do so, please contact: support@listreports.com. Please note that we may ask you to verify your identity and request before taking further action on your request.

  • Managing your Account information. You may access and update your account information and preferences through your Account settings. 

  • Correcting your information. You have the right to ask us to correct inaccurate or incomplete personal information about you (and which you cannot update yourself within your Account settings). 

  • Opt out of marketing communications. You may opt out of marketing-related emails by following the opt-out or unsubscribe instructions at the bottom of the email, or by contacting us at support@listreports.com. You may continue to receive service-related and other non-marketing emails. If you receive marketing text messages from us, you may opt out of receiving further marketing text messages from us by replying STOP to our marketing message. 

  • Cookies & Browser Web Storage. Most browsers let you remove or reject cookies. To do this, follow the instructions in your browser settings. Many browsers accept cookies by default until you change your settings. Please note that if you set your browser to disable cookies, our websites may not work properly. Similarly, your browser settings may allow you to clear your browser web storage.

  • Location Data. You can change your device settings to stop sharing precise geolocation data with us. 

  • Third Party Platforms. If you choose to connect to the Service via a third-party platform or social media network, you may have the ability to limit the information that we may obtain from the third-party at the time you login to the Service using the third-party’s authentication service or otherwise connect your account. Subsequently, you may be able to control your settings through the third-party’s platform or service. 

  • Third Party Data: We do not control or supervise how the third parties providing your information process your Personal Information; any information request regarding the disclosure of your personal information to us by that third party should be directed to them.

  • Withdrawing Consent. If we are processing your personal information based on your consent you may withdraw that consent at any time by changing your Account settings or by sending a communication to ListReports specifying which consent you are withdrawing. Please note that the withdrawal of your consent does not affect the lawfulness of any processing activities based on such consent before its withdrawal. In addition, as described above, we need to collect your personal information to provide you the LR Services. If you do not provide the information requested, we may not be able to provide those services. 

5. Other Sites, Mobile Applications and Services. The LR Services may contain links to other websites, mobile applications, and other online services operated by third parties. These links are not an endorsement of, or representation that we are affiliated with, any third party. In addition, our content may be included on web pages or in mobile applications or online services that are not associated with us. We do not control third party websites, mobile applications or online services, and we are not responsible for their actions. Other websites, mobile applications and services follow different rules regarding the collection, use and sharing of your personal information. We encourage you to read the privacy policies of the other websites, mobile applications and online services you use.

6.  Security

ListReports is committed to protecting the Personal Information you share with us. We utilize a combination of industry-standard security technologies, procedures, and organizational measures to help protect your Personal Information from unauthorized access, use, or disclosure. We are also continuously implementing and updating administrative, technical, and physical security measures to help further protect your Personal Information. We recommend you take every precaution in protecting your Personal Information when you are on the Internet. For example, change your passwords often, use a combination of upper and lower-case letters, numbers, and symbols when creating passwords, and make sure you use a secure browser. If you know or have reason to believe that your LR Account credentials have been lost, stolen, misappropriated, or otherwise compromised or in case of any actual or suspected unauthorized use of your LR Account, please contact us at support@listreports.com.

7.  Update to this Privacy Policy

We are always reviewing our privacy practices to make sure they comply with this policy.  Sometimes, we’ll need to update our Privacy Policy to reflect changes in our services, technology, and uses of data. When our Privacy Policy is updated, we will post those changes on this page; you can see when this policy was last updated by checking the "last updated" date displayed at the top of this policy. In addition we may, and if required by law will, also provide notification of changes in another way that we believe is reasonably likely to reach you, such as notification through the LR Platform. Any modifications to this Privacy Policy will be effective upon our posting the new terms and/or upon implementation of the new changes on the LR Service (or as otherwise indicated at the time of posting). In all cases, your continued use of the LR Platform after the posting of any modified Privacy Policy indicates your acceptance of the terms of the modified Privacy Policy.

9.  CALIFORNIA PRIVACY NOTICE FOR CALIFORNIA RESIDENTS

This section applies only to California residents. It describes how we collect, use and share Personal Information of California residents in operating our business, and their rights with respect to that Personal Information. For purposes of this section, “Personal Information” has the meaning given in the California Consumer Privacy Act of 2018 (“CCPA”) but does not include information exempted from the scope of the CCPA. PLEASE NOTE THAT THIS CA NOTICE DOES NOT APPLY TO THE PERSONAL INFORMATION THAT WE PROCESS IN OUR ROLE AS A SERVICE PROVIDER.

A.  Your California privacy rights. Residents of California may be entitled to certain rights with respect to personal information that we have collected about them under the CCPA. However, these rights are not absolute and, in certain cases, we may decline your request as permitted by law.

  • Right to Know. You can request the following information about how we have collected and used your Personal Information during the past 12 months:

    • The categories of Personal Information that we have collected.

    • The categories of sources from which we collected Personal Information.

    • The business or commercial purpose for collecting and/or selling Personal Information.

    • The categories of third parties with whom we share Personal Information.

    • Whether we have disclosed your Personal Information for a business purpose, and if so, the categories of Personal Information received by each category of third party recipient.

    • Whether we’ve sold your Personal Information, and if so, the categories of Personal Information received by each category of third party recipient.

  • Right to Access. You can request a copy of the Personal Information that we have collected about you during the past 12 months.

  • Right to Request Deletion. You can ask us to delete the Personal Information that we have collected from you, subject to certain exceptions.

  • Right to Opt-out of Sales. If we sell (as such term is defined by the CCPA) your Personal Information, you can opt-out. In addition, if you direct us not to sell your Personal Information, we will consider it a request pursuant to California’s “Shine the Light” law to stop sharing your personal information covered by that law with third parties for their direct marketing purposes.

  • Right to be free from Discrimination for Exercising Your Rights. You are entitled to exercise the rights described above free from discrimination in the form of legally prohibited increases in the price or decreases in the quality of our LR Services. However, please note that if the exercise of these rights limits our ability to process personal information (such as in the case of a deletion request), we may no longer be able to provide you the Services or engage with you in the same manner.

B.  How to Exercise your California Privacy Rights

You may exercise your California privacy rights described above as follows:

  • Right to information, access and deletion. You can request to exercise your information, access and deletion rights by:

  • Right to opt-out of the “sale” of your Personal Information. We do not sell Personal Information to marketing companies, advertisers, or anyone else in exchange for payment. Except as described above, we do not allow any third parties access to any Personal Information we collect in the course of providing services to Members. We do not allow third parties to use any Personal Information obtained from us for their own purposes, unless it is with your consent (e.g. when you access a third-party integration). Thus, in our humble opinion, we don’t think the majority of our Members would see us as selling their information, as that practice is commonly understood.  

That said, ListReports does use certain standard advertising tools that require Personal Information (think, for example, Google Ads and Google Analytics). We use these tools to help us improve your advertising experience (such as serving advertisements on our behalf across the Internet, serving personalized ads on our website, and providing analytics services). Sharing Personal Information with the third-party provider while using these tools may fall within the extremely broad definition of the “sale” of Personal Information under the California Privacy Laws because those companies might use Personal Information for their own business purposes, as well as ListReports’ purposes. For example, Google may use this data to improve its advertising services for all companies who use their services. (It is important to note advertising programs have historically operated in this manner. It is only with the recent developments in data privacy laws that such activities fall within the definition of a “sale”). By visiting www.privacyrights.info or www.optout.privacyrights.info, you can opt out from sales of this type of personal information by businesses that participate in the opt out tool. To make opt-out requests related to mobile apps on your device for businesses participating in the DAA’s CCPA App-based Opt-Out Tool, you can download the app at www.youradchoices.com/appchoices.  

  • Shine the Light. California’s "Shine the Light" law (Civil Code Section §1798.83) provides certain rights to California residents that have an established business relationship with us with regard to the disclosure of certain types of personal information to third parties for their direct marketing purposes. Again, we do not share your personal information with third parties for their direct marketing purposes without consent.

  • Minors. We do not sell the personal information of consumers we know to be less than 16 years of age. 

  • Verifying Your Request. Please provide your name, email address, and the consumer right you would like to exercise, and let us know if you are submitting the request for yourself or on behalf of another user.  We will need to verify your identity before processing your request, which may require us to request additional personal information from you or require you to log into your account, if you have one. As a part of this process, government identification may be required. In certain circumstances, we may decline or limit your request, particularly where we are unable to verify your identity or locate your information in our systems, or as otherwise permitted by law. Please note that we are only required to respond to one request per customer each year, and we are not required to respond to requests made by means other than through the above email address.

    • Authorized Agents. In certain circumstances, you are permitted to use an authorized agent (as that term is defined by the CCPA) to submit requests on your behalf through the designated methods set forth in this California Notice where we can verify the authorized agent’s authority to act on your behalf. For requests to access/know or delete personal information, we require the following for verification purposes: (a) a power of attorney valid under the laws of California from you or your authorized agent; or (b) sufficient evidence to show that you have: (i) provided the authorized agent signed permission to act on your behalf; and (ii) verified your own identity directly with us pursuant to the instructions set forth in this California Notice; or directly confirmed with us that you provided the authorized agent permission to submit the request on your behalf. For requests to opt-out of personal information “sales”, we require a signed permission demonstrating your authorized agent has been authorized by you to act on your behalf.

We are required to explain the categories of Personal Information we collect by reference to the categories specified by the CCPA in California Civil Code § 1798.140(o), which are described in the list below. For each category, we list the type of data we collect and the source of that data as described in the section above entitled Information We Collect (Section 1)

  • Identifiers

    • What we collect: Account Information, including Professional Information for REPs and Contact Information for Consumers; Profile Data; Listing Information; Household Data for Consumers; Profile Data; Communications, Client, Co-Buyer, and/or REP contact information, and Member Content

    • Sources: You, other Members, Third Party Data providers, public sources, business partners

  • Commercial information
